September 2025: eight containers on four weeks' credit
On 2 September 2025, MG-Atlantic offered Contenedores MAS+ eight 40HC containers: two in IICL condition and six cargo-worthy. The payment terms were confirmed in writing: four weeks of credit.
Oscar Adán, Commercial Director of Contenedores MAS+, accepted the same afternoon:
"De acuerdo con tu propuesta con estos 8 equipos."
(We agree with your proposal for these 8 units.)
The next day, the company sent its purchase order. MG-Atlantic issued invoice MGC-443 for USD 15,300 and delivered the containers to the buyer's yard in El Sauzal, Ensenada.
This was a gate-buy sale: delivery first, payment later. Between established operators, it is normal practice. It only works if the buyer pays.
October and November 2025: a partial payment, then promises
Contenedores MAS+ paid USD 5,750. The remaining USD 9,550 never came.
After reminders on 18 and 22 October, MG-Atlantic sent a formal notice on 5 November: five business days to pay, or formal recovery in Mexico and Switzerland.
Oscar Adán replied on 10 November:
"Please give us the opportunity to settle the full invoice by the 30th of this month. We went through a couple of complicated situations, but we are already recovering."
MG-Atlantic gave them the time. On 30 November: nothing. On 1 December, he asked for two more weeks "para poder avanzar con la deuda" (to move forward with the debt). Nothing again.
December 2025: the containers had already been resold
On 23 December, Oscar Adán explained where the containers were:
"Nosotros también vendimos a crédito estos contenedores a una empresa maquiladora en la ciudad de Tijuana, no hemos recibido el pago."
(We also sold these containers on credit to a maquiladora in Tijuana, and we have not been paid.)
In other words, Contenedores MAS+ had resold, for its own account, containers it had not paid for.
In the same message, he proposed a three-month plan: 2 units in January, 2 in February, 3 in March. MG-Atlantic accepted the same day, on one condition: a short commitment signed by the company's legal representative. His answer on 26 December:
"Si claro, trabajamos en el documento!"
(Yes, of course, we are working on the document!)
January 2026: the document never came
No signature. No instalment. MG-Atlantic followed up five times in January 2026. The final deadline of 23 January passed without a reply.
May 2026: "I don't remember any debt"
MG-Atlantic instructed a Mexican collection agency staffed by commercial lawyers. The agency reported that the company had "negado toda comunicación" (refused all communication).
When the agency finally reached Oscar Adán, he said he "no recordaba tener un adeudo pendiente": he did not remember owing anything.
Six months earlier, the same man had written: "Please give us the opportunity to settle the full invoice."
June and July 2026: "no effective means of collection"
In June, the agency's lawyer served a formal payment demand at the company's premises in Tijuana. A lawyer acting for Contenedores MAS+ and its legal representative, Eric Segura, then came forward. He cited financial difficulties that had delayed payments "a diversos proveedores" (to various suppliers). MG-Atlantic is not the only supplier left unpaid.
On 20 June, Eric Segura offered MXN 6,000 a month, about USD 350: more than three years to repay. The agency recorded his position:
"Al tratarse de un acreedor extranjero, consideraba que no existían mecanismos efectivos de cobro y exigibilidad en México."
(As the creditor is foreign, he considered there were no effective means of collection and enforcement in Mexico.)
He is wrong. Claims based on documents issued abroad are enforceable in Mexican courts.
To close the matter, MG-Atlantic still accepted MXN 8,000 a month plus interest on 8 July. A first payment was promised for the end of July. It never arrived, and the agreement was never signed.
Since August 2026: silence
On 3 August, the agency reported that the debtor's lawyer had stopped answering, "manteniendo una clara negativa de pago" (maintaining a clear refusal to pay).
On 1 October 2026, the agency closed its file. Amount recovered: USD 0.
MG-Atlantic no longer expects Contenedores MAS+ to pay voluntarily. Legal proceedings in Mexico are being prepared.
Blacklisted by MG-Atlantic
MG-Atlantic has blacklisted Contenedores MAS+. We will not sell, lease or release containers to this company.
We advise container sellers, lessors, depots and transport providers to deal with Contenedores MAS+ only against full payment in advance, and never to release containers to it on credit.
Is Contenedores MAS+ a scam?
Many companies search for "Contenedores MAS scam" or "Contenedores MAS fraude" before trading with it. MG-Atlantic does not issue legal findings: only a court can establish fraud. What we can document is what happened to us:
- they took delivery of eight containers on credit;
- they resold them before paying;
- they acknowledged the debt in writing, again and again;
- they proposed three payment plans and honoured none;
- their Commercial Director then said he remembered no debt;
- they stopped responding.
Judge for yourself. Our decision is made: Contenedores MAS+ is on MG-Atlantic's blacklist.
How to protect yourself against container payment fraud
Before releasing containers on credit to a new buyer, in Mexico or anywhere else:
- ask for full payment, or at least a deposit, before gate-out or delivery;
- verify the legal entity: legal name, tax ID (RFC in Mexico) and who is authorised to sign;
- have the credit terms signed by the legal representative, not only agreed by e-mail;
- keep title to the containers until full payment, in writing;
- search the buyer's name with "scam", "fraud", "blacklist" and "unpaid" before the first deal.
Amount claimed
As of 3 October 2026:
- principal: USD 9,550.00, balance of invoice MGC-443 of 3 September 2025;
- late-payment interest at 12% per year from the invoice date: USD 1,240.19, plus USD 3.14 per day;
- recovery costs to date: USD 1,000.00, plus the collection commission on any amount recovered;
- total: USD 11,790.19, before the costs of legal proceedings.
